Course Objective:

This advanced course is designed for immigration advisers preparing for the IAA Level 2 assessment. It focuses on the immigration routes covered in the Level 2 exam, with a particular emphasis on more complex cases, immigration categories, and the legal frameworks surrounding them. Participants will gain a deeper understanding of the eligibility criteria, application processes, and grounds for refusal for each immigration route, as well as key strategies for navigating these in the assessment. The course also includes practical exercises, case studies, and exam preparation techniques to ensure participants are well-prepared for the IAA Level 2 exam.

Module 1 – Introduction to IAA Level 2 accreditation

• Overview of the work covered at Level 2
• Understanding the IAA Level 2 assessment structure
• Key areas for the IAA Level 2 exam
• How to approach the Level 2 exam and succeed with advanced legal reasoning and application of immigration law

Module 2 – Advanced immigration routes

• When does a standard application become complex
• Spouse/ Partner visas under the 10 year route and complex cases
• Parent and child visas under the 10 year route and complex cases
• How Article 8 of the ECHR applies to Appendix FM
• Adult Dependent Relatives and long term care requirements
• Family reunion

Module 3 – Asylum, Humanitarian Protection and Refugee routes

• Eligibility for asylum in the UK
• The refugee convention
• Common pitfalls in applications
• Understanding humanitarian protection and discretionary leave as alternatives to refugee status
• Deportation and Human Rights
• Articles 8 and 3 of the ECHR and their application in Immigration law

Module 4 – Legal and ethical considerations in Immigration casework

• Best practice for ensuring applications are accurate, truthful and comply with immigration law
